1. Who we are

The Association is the data controller for personal data processed through this website.

Part I — Terms & Conditions

2. Acceptance

By accessing or using neweconomy.institute (the “Site”) you agree to these Terms. If you do not agree, please do not use the Site.

3. Purpose of the Site

The Site provides information about the Association, its research, publications, events and activities relating to digital economy and technology policy in Portugal. Content is provided for general information purposes only.

4. No professional, financial or investment advice

Nothing on the Site constitutes financial, investment, tax, legal or other professional advice, nor an offer, solicitation or recommendation to buy, sell or hold any asset, including digital assets or cryptocurrencies. Content reflects research and policy analysis and may become outdated. You should obtain independent professional advice before acting on any information found here, and you act on it at your own risk.

5. Third-party links and services

The Site links to third-party websites and services, including event registration platforms such as Luma. These are operated independently of the Association. When you follow such a link you leave the Site, and the third party’s own terms and privacy policy govern your use of their service and any data you provide to them. We do not control and are not responsible for the content, availability, security or practices of third-party services.

6. Events

Registration for events organised or promoted by the Association may be handled by third-party platforms. Event details, including dates, times, venues and programme, may change or be cancelled. Attendance may be subject to capacity limits, venue rules and separate conditions communicated at the point of registration.

7. Intellectual property

Unless otherwise stated, the content of the Site — including text, publications, reports, graphics, logos and design — is owned by the Association or used with permission. You may read, quote and share content for non-commercial purposes with clear attribution and a link to the source. You may not reproduce, republish or exploit content commercially without our prior written permission. Third-party names and logos shown on the Site remain the property of their respective owners.

8. Acceptable use

You agree not to use the Site unlawfully, to attempt unauthorised access to it or its infrastructure, to disrupt its operation, or to extract data by automated means without our consent.

9. Availability and liability

The Site is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, error-free or free of harmful components, and we do not warrant the accuracy or completeness of its content. To the fullest extent permitted by Portuguese law, the Association excludes liability for any indirect or consequential loss arising from use of, or inability to use, the Site or any third-party service linked from it. Nothing in these Terms limits liability where such limitation is prohibited by law.

10. Changes

We may update these Terms from time to time. The version published on this page, bearing the date above, is the version in force.

11. Governing law

These Terms are governed by Portuguese law. The courts of Lisboa have jurisdiction over any dispute, without prejudice to any mandatory consumer protections available to you.

Part II — Privacy Policy

We do not sell personal data, and we do not use it for automated decision-making or profiling.

13. Who we share it with

We use the following service providers, who process data on our behalf or as independent controllers:

Twilio SendGrid — email delivery and newsletter subscriptions, including the signup widget on this Site. Data may be processed in the United States.
Google (Google Tag Manager and Google Analytics) — website analytics, loaded only where you have consented to analytics cookies. Data may be processed in the United States.
Google Fonts — typefaces used in the Site’s design are requested from Google servers when a page loads, which involves transmitting your IP address to Google.
Luma — where you register for one of our events, registration is handled on Luma’s platform under their own privacy policy.
Our hosting provider — for the operation and security of the Site.

We may also disclose data where required by law or to establish or defend legal claims.

14. Transfers outside the EEA

Some of the providers above are established in the United States. Where personal data is transferred outside the European Economic Area, the transfer relies on the European Commission’s adequacy decision for the EU–US Data Privacy Framework where the provider is certified, or otherwise on Standard Contractual Clauses.

15. How long we keep it

Newsletter subscriptions: until you unsubscribe or ask us to delete your data.
Correspondence: normally up to two years after our last exchange.
Analytics data: according to the retention period configured in Google Analytics.
Server logs: a short rolling period for security purposes.

16. Cookies and similar technologies

We use cookies that are strictly necessary for the Site to function, and — only with your consent — analytics cookies that help us understand how the Site is used. When you first visit, a banner lets you accept or decline non-essential cookies. Non-essential cookies are not set before you consent.

You can change or withdraw your choice at any time by clearing this site’s cookies in your browser and reloading the page, or by using your browser’s privacy settings to block cookies altogether.

17. Your rights

Under the GDPR you have the right to:

access the personal data we hold about you;
have inaccurate data corrected;
have your data erased;
restrict or object to our processing;
receive your data in a portable format;
withdraw consent at any time, without affecting processing carried out before withdrawal.

If you believe we have handled your data improperly, you may lodge a complaint with the Portuguese supervisory authority, the Comissão Nacional de Proteção de Dados (CNPD) — www.cnpd.pt.

18. Children

The Site is not directed at children under 16, and we do not knowingly collect their personal data. If you believe we have, please contact us and we will delete it.

19. Changes to this policy

We may update this policy. Material changes will be reflected in the date at the top of this page.
